Please read these Terms and Conditions carefully prior to your participation.
Participation in the Event is subject to the organization of the Event (e.g., venue, program, video recording) and these Terms and Conditions, which together with any applicable annexed legal framework constitute the agreement between the participant and Bosch for participation in the Event.
Inquiries and complaints can be directed to Bosch at the contact details above.
Bosch has engaged Follow Red GmbH ("Follow Red") to manage and process participant registration, hotel management, travel management, and email support services.
2.1 Bosch organizes the Event exclusively for business customers and does not accept consumers as defined under § 13 BGB (German Civil Code) as participants. Registration is only possible via the online platform provided by Bosch at https://www.bosch-pro-dealer-event.com.
2.2 The duration and content of the Event are set forth in the Event program. Bosch strives to ensure the accuracy of the published Event program at the time of the Event. However, due to unforeseen circumstances, it may be necessary to modify the program before the Event, and Bosch reserves the right to do so pursuant to clause 6 of these Terms and Conditions.
2.3 By registering, the participant accepts these Terms and Conditions. Deviating conditions require written form. Conflicting or supplementary conditions of the participant shall be invalid, even if referred to in participant orders or other documents and Bosch does not expressly object.
2.4 Bosch reserves the right to select participants. Participation is only possible after written confirmation by Bosch.
2.5 Participation is personal and non-transferable without Bosch’s consent.
2.6 Registration proceeds as follows: receipt of an official invitation by email or postal mail; participant registration on the registration page via link or QR code; receipt of confirmation of participation.
3.1 For selected participants, Bosch covers the costs for:
3.1.1 Participation in the Event including all program items.
3.1.2 Travel to and from the Event venue. If traveling by airplane, the means of transport will be chosen and booked by Bosch. Bosch organizes transfers from the airport to the hotel and Event venue. Taxi or individual transfer costs are not covered unless expressly agreed in advance. For travel by other means (e.g., train, bus, car), the participant is responsible for booking and selection; Bosch reimburses these costs accordingly.
3.1.3 Accommodation at a hotel selected by Bosch for the duration of the Event (including breakfast).
4.1 Access to the Event on-site is only granted upon presentation of a personalized, valid invitation approved by Bosch or Follow Red, which must be shown upon request.
4.2 Collection of an Event badge on-site requires a valid photo ID for each participant.
4.3 Event badges issued by Bosch must be worn visibly throughout the Event.
4.4 The participant agrees to comply with instructions from Event staff and the house rules of Motorworld Metzingen. Additional restrictions or requirements regarding safety (e.g., safety clothing, safety instructions) may apply and must be observed.
4.5 The participant commits not to engage in unlawful acts or damage Bosch’s reputation during the Event.
Bosch reserves the right to cancel the Event for good cause (e.g., force majeure, pandemic). Participants will be informed immediately. Further claims by participants are excluded unless Bosch acts with intent or gross negligence.
6.1 The Event is planned for the location, date, and time specified in the program. The participant acknowledges and agrees that Bosch may, for justified reasons and considering all legitimate interests and if reasonable for the participant, change the venue, date, time, content, duration, or opening hours. Bosch will endeavor to inform participants as soon as possible. In case of such reasonable changes, the agreement shall apply to the new arrangements, and no right of withdrawal shall arise. Claims for damages, including expenses or lost profits, are excluded. Such changes do not constitute cancellation by Bosch. If the participant wishes to cancel, the applicable cancellation policy under Bosch’s General Terms and Conditions applies.
6.2 If the Event cannot take place due to force majeure or similar circumstances, Bosch may at its discretion (a) cancel the Event or (b) postpone it to a new date.
6.2.1 In case of postponement, the agreement shall apply to the new date.
6.2.2 Except for remaining obligations under these provisions, Bosch is released from further obligations.
6.2.3 Costs caused by the parties related to third parties shall be borne by those parties themselves. Claims for damages due to non-performance, especially lost profits, are excluded.
6.3 Force majeure or similar events mean all events beyond Bosch’s control that (i) could not have been averted with reasonable effort; (ii) were unforeseeable even with due care; and (iii) significantly impede or make Bosch’s performance impossible, in whole or in part. Such events include natural disasters (earthquakes, extreme weather), war, terrorism, epidemics, pandemics, strikes, lawful lockouts, travel restrictions, operational or transport disruptions, official orders, prohibitions, trade blockades, embargoes, raw material shortages, and transport limitations not attributable to Bosch.
7.1 The participant acknowledges that Bosch or its service providers may record, photograph, or film them during the Event and agrees that such material may be used by Bosch for promotional purposes beyond reporting on the current Event. The participant also agrees that audio and audiovisual recordings may be transmitted and published via broadcasters, the internet, or other media. All rights to such materials remain with Bosch.
7.2 The participant is aware that materials may be used on websites and can be technically downloaded by any internet user. Bosch is not obliged to take legal action against unauthorized use by third parties. The participant waives any claims against Bosch or affiliated companies arising from unauthorized third-party use.
7.3 Other participants may also record the participant’s image or voice in photos, videos, or streaming formats, which Bosch cannot control and for which Bosch disclaims any liability.
7.4 The participant may not produce or distribute live streams, recordings, or films of the Event without Bosch’s explicit permission.
8.1 Bosch’s liability is governed by statutory provisions: (i) in cases of intent or gross negligence, (ii) under the Product Liability Act, (iii) to the extent of any warranty undertaken by Bosch, and (iv) for injury to life, body, or health.
8.2 For simple negligence causing property or financial damage, Bosch and its agents are liable only for breach of essential contractual obligations (“cardinal obligations”), and liability is limited to foreseeable, typical damages at the time of contract conclusion.
8.3 If the participant is a business, Bosch’s liability under clause 8.2 is limited to the total amount paid by the participant to Bosch in the 12 months prior to the damage event, but at least EUR 50,000.
8.4 Any further liability of Bosch is excluded.
8.5 Statutory liability limitations that deviate in favor of Bosch remain unaffected.
8.6 These liability limitations also apply to the fault of Bosch’s agents and the personal liability of Bosch employees, representatives, and organs.
9.1 Bosch reserves the right to exclude a participant from the Event if their behavior endangers the purpose of the Event for other participants.
9.2 In case of exclusion, Bosch may charge the participant for incurred travel, accommodation, and other costs as damages unless the participant proves no or lesser damage.
10.1 Bosch processes personal data of participants exclusively under applicable data protection laws. Details are set forth in Bosch’s Privacy Policy, accessible at [insert link to privacy policy].
10.2 Bosch commissions Follow Red with registration management, ticketing, data storage and hosting, and hotline services. Bosch has carefully selected and regularly monitors Follow Red, especially regarding the protection and careful handling of participant data.
11.1 The participant agrees to keep confidential all information and materials marked by Bosch as “confidential” or otherwise to be treated as confidential (“Confidential Information”) and not disclose them to third parties. The participant shall exercise at least the same degree of care as for their own confidential information of similar importance.
11.2 The confidentiality obligation does not apply to information that (a) was lawfully in the participant’s possession before disclosure by Bosch; (b) is or becomes publicly known without breach; (c) was lawfully received from a third party without confidentiality obligations; (d) Bosch discloses to third parties without confidentiality restrictions; (e) is independently developed by the participant; (f) must be disclosed by law; or (g) is disclosed with Bosch’s prior written consent.
11.3 Event materials and other electronic content provided by Bosch, such as animations, contain copyrighted information. These materials may only be used for the purpose of the Event. The participant acquires a non-exclusive, non-transferable right of use limited to registered participants. Unauthorized reproduction, modification, distribution, or public display without Bosch’s written consent is prohibited. The participant may not remove copyright notices, trademarks, digital watermarks, or other rights notices.
12.1 Bosch may engage additional external service providers for performing services.
12.2 German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict of law rules. The place of jurisdiction is Stuttgart.
12.3 If any provision is invalid, the remaining provisions shall remain effective. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the invalid one.
