Terms and Conditions of Participation, PRO Deal Accessory

 

By participating in the Pro Deal Accessories Promotion (hereinafter referred to as the "Promotion Campaign") you accept these Terms and Conditions of Participation.

 

1. Organiser

2. Campaign period 

The Promotion Campaign runs from 01.01.2024 (00:00 GMT) to 30.04.2024 (24:00 GMT) (hereinafter referred to as the "Campaign Period").

 

3. Participation 

To be able to participate in the Promotion Campaign, you must satisfy the following requirements within the Campaign Period:

1)    Buy Bosch Power Tool Accessories (hereafter “Promotional Products”) with a total value of more than £66 or €92,30 (incl. VAT) to receive a category A reward or Promotional Products with a total value of more than £138 or €184,50 (incl. VAT) to a receive a category B reward. Battery packs, chargers, carrying cases and guide rails are excluded from the Promotional Products.

2)    Visit the PRO Deals promotion webpage at the following link: www.pro360.com/prodeals - this page takes you to the PRO Deals web application (hereinafter "PRO Deals").

3)    When you participate in PRO Deals, a personal PRO360 user profile is created for you, if you do not already have one. For further information about PRO360 see the general terms and conditions here.

4)   Enter the stock keeping unit (SKU), the date of purchase, and the individual net prices of all the Promotion Products you have purchased.

5)    Upload the invoice or delivery note for your purchased Promotional Products to PRO Deals by taking a photo of the invoice or delivery note or uploading it via file upload. Please note that all Promotional Products must be purchased in a single purchase and that the individual prices and the date of purchase must be clearly visible on a collective invoice.

6)    You will be shown the rewards (as further explained in Section 4) provided you meet all these Terms and Conditions of Participation.

7)    Enter your delivery address and complete the participation process.

The Promotional Products must be bought in a single purchase within the Campaign Period.  If the invoice date is within the Campaign Period, then this demonstrates that the purchase was within the Campaign Period. If the invoice date is outside the Campaign Period, it is up to you to prove that the Promotional Product was purchased within the Campaign Period (and within a single purchase). The Promotional Products must be registered on the PRO Deals website (namely the steps 2-7 as identified above) within 30 days of the end of the Campaign Period.

 

4. Reward

When you purchase Promotional Products with a total value of more £66 or €92,30 (incl. VAT) you can choose a product from category A as a reward if you participate in the Promotion Campaign and comply with these Terms and Conditions of Participation. When you purchase Promotional Products with a value of more than £138 or €184,50 (incl. VAT) you can choose a product from category A or B as a reward if you participate in the Promotion Campaign and comply with these Terms and Conditions of Participation. You can find the currently available product rewards, for both category A and category B, in relation to the Promotion Campaign from Bosch on the PRO Deals website. The displayed rewards are available and can be selected while stocks last. You may only choose one reward.

 

5. Eligible participants and participation requirements, delivery 

Participation is open to natural persons who are aged 18 and over. Employees of Bosch and other companies involved in carrying out the Promotion Campaign are excluded from participation. Participation using false identities or the identities of third parties is strictly prohibited. Automated participation (e.g. using participation and registration services) is not permitted. Fraudulent activity involving website hacking, use of automation software, exploitation of software bugs, etc. will result in the exclusion of participant. Bosch reserves the right to exclude any participant who makes insulting, threatening or otherwise unacceptable comments or who violates these conditions of participation. The Promotion Campaign is aimed at end users. This includes both consumers and entrepreneurs/traders. For the purposes of these Terms and Conditions of Participation, “consumers” are individuals who engage in a legal transaction for purposes that are wholly or mainly outside that individual’s trade, business, craft, or profession. Conversely, “an entrepreneur/trader” is any individual or legal person who, when entering into the contract, is acting for purposes relating to that person’s trade, business, craft or profession, regardless of whether they are acting personally or through another person acting in their name or on their behalf.

Entrepreneurs/traders may participate in the Promotion Campaign unlimited times (for each purchase) during the period specified in section 3. Private users are entitled to participate a maximum of 3 times within the period specified in section 3. Eligible participants are not permitted to participate multiple times using different e-mail addresses.

This Promotion Campaign cannot be combined with other campaigns and discounts of the Bosch Group, specifically of Robert Bosch Limited. The Promotion Campaign applies exclusively to the purchase of Promotional Products bought from a retailer based in the United Kingdom and Republic of Ireland (both offline and online). In the event of revocation or withdrawal from the purchase contract, you shall not be entitled to take part in the Promotion Campaign. If the device is returned, the reward must be returned to Bosch if it has already been granted. The refund claim shall be legally enforced. A resale or distribution of the received rewards is not permitted.

Rewards are usually delivered within 4 weeks after they have been ordered (unless otherwise stated on the www.pro360.com/prodeals website). Bosch will deliver the reward only to addresses within the United Kingdom and Republic of Ireland. Bosch shall pay the costs for shipping the reward. The reward may not be exchanged, collected personally or paid out in cash.

7. Liability

To the extent permitted by law, the rewards shall be made available to you to the exclusion of any warranty whatsoever. However, this shall not apply if the warranty claim is for compensation and the claim is based on gross negligence or intentional misconduct on the part of Bosch or its vicarious agents. Compensation claims due to loss of life, physical injury or damage to health, or based on product liability laws and regulations or based on consumer protection laws and regulations shall also remain unaffected. In particular, Bosch shall not be obliged to replace or repair the rewards but will review this on an individual case.

 

8. Miscellaneous

We shall reserve the right to change all conditions at any time. Whenever you take part in a Promotion Campaign of Robert Bosch Limited, the Terms and Conditions of Participation available online at the time shall apply. In your own interest, always make sure to check the Terms and Conditions of Participation before you take the offer. It is therefore in your own interest to always check the Terms and Conditions of Participation before you make use of the offer. If individual provisions of these Terms and Conditions of Participation are or become invalid or incomplete, the validity of the remaining provisions shall remain unaffected.

Bosch shall reserve the right to end or temporarily suspend the Promotion Campaign on reasonable grounds. This shall apply, in particular, if the Promotion Campaign cannot be duly implemented or can no longer be guaranteed due to legal or material reasons. 

The contractual relationships between you and Bosch shall be subject to English law or if you are a consumer based in Ireland, the laws of Ireland. If you are a consumer, this choice of law shall only apply if it does not deprive you of the protection provided by the mandatory provisions of the law of the state in which you usually reside (favourability principle). Application of the UN Convention on the International Sale of Goods (CISG) shall be excluded.

If you are a consumer, you can bring legal proceedings in respect of these Terms and Conditions of Participation in the English courts. If you are a consumer and live in Scotland, you can bring legal proceedings in respect of these Terms and Conditions of Participation in either the Scottish or the English courts. If you are a consumer and live in Northern Ireland, you can bring legal proceedings in respect of these Terms and Conditions of Participation in either the Northern Irish or the English courts. If you are a consumer and live in Republic of Ireland, you can bring proceedings in respect of these Terms and Conditions of Participation in the courts of Ireland. In all other cases, the exclusive jurisdiction shall be the English courts.

 

9. Data protection

Bosch is pleased to see that you are interested in our company, products and campaigns. For us, the protection of your privacy during the processing of personal data and the security of all business data are important matters which we take into account in our business processes. We process personal data confidentially and always in accordance with legal provisions. Data protection and information security form an integral part of our company policy.

Basic principles

Personal data is all information that relates to an identified or identifiable natural person, for example names, addresses, telephone numbers, e-mail addresses and contractual, accounting and billing information, that expresses an individual's identity.
We only collect, process, and use personal data (including IP addresses) if there is a legal basis to do so or you have granted us your consent to do so, for example during registration.

Processing purposes and legal basis

We and the service providers we contract process your personal data for the following processing purposes:
- Participation in the PRO Deals Promotion Campaign (legal basis: performance of the contract)
- Self-promotion and third-party promotion, as well as market research and reach analysis to the legally permitted extent or on the basis of consent (legal basis: consent / our legitimate interest in direct marketing provided it complies with data protection and competition regulations).
- Product and/or customer surveys by post (legal basis: legitimate interest in the improvement of products/services, consent).
- Product and/or customer surveys by e-mail and/or telephone, provided you have expressly opted into them (legal basis: consent).
- Sending a newsletter with the recipient's consent by e-mail or text message/MMS (legal basis: consent).
- Safeguarding and defending our rights (legal basis: our legitimate interest in asserting and defending our rights).


 Registration

If you would like to use services that require a contract to be entered into, we will ask you to register. The registration process involves collecting the personal data required for establishing and performing the contract (e.g. forename, surname, date of birth, e-mail address, telephone number, address) and any other data provided on a voluntary basis. Mandatory information is marked with a *.

Forwarding data to other controllers

We will only ever pass on your personal data to other controllers if this is necessary in order to perform the contract, if we or the third party have/has a legitimate interest in passing on the data, or if you have granted your consent to this. Details about the legal basis and recipients and/or categories of recipients are provided in the “Processing purposes and legal basis” section. In addition, data may be passed on to other controllers if we are obliged to do so on the basis of legal provisions or enforceable official or judicial orders.

 

Forwarding of data

Service providers

We commission external service providers to perform tasks such as sales and marketing services, contract management and payment processing. We have selected these service providers with care and monitor them on a regular basis, particularly with regard to the careful handling and safeguarding of the data they store. All the service providers are required by us to maintain confidentiality and comply with statutory requirements. Service providers may also be other companies in the Bosch Group.

Storage period; retention periods

We store your data for as long as is necessary to provide our online services and the related services, for as long as we have your consent to process your personal data or for as long as we have a legitimate interest in storing it further (e.g. we may still have a legitimate interest in postal marketing even after the contract has been performed). After this time, we will erase your personal data, with the exception of the data that we must continue storing in order to comply with legal obligations (e.g. due to retention periods under tax and commercial law, we are obliged to retain, for example, contracts and invoices for a certain period).

Security

Our employees and the service providers we contract are obliged to maintain confidentiality and to comply with the provisions of the applicable data protection legislation.
We take all required technical and organisational measures to guarantee an appropriate level of protection and to protect your data that is managed by us in particular from risks of unintentional or wrongful destruction, manipulation, loss, modification or unauthorised disclosure and unauthorised access. Our security measures are continually improved in accordance with the state of technological developments.

Right to information and right of access by the data subject

You have the right to obtain information from us about the processing of your data. To do so, you can assert your right of access in relation to your personal information that we process.

Right to rectification and erasure

You may request us to rectify incorrect data and, provided the legal requirements are met, complete or erase your data.
This does not apply to data that is necessary for billing and accounting purposes, or that is subject to legal obligations to retain data. However, if access to this data is not required, the processing of such data is restricted (see below).

Restriction of processing

You may request us to restrict the processing of your data, provided the legal requirements are met.

 

Withdrawal of consent

If you have granted us your consent to process your data, you can withdraw this consent at any time with effect for the future. The lawfulness of the processing of your data will remain unaffected by this up to the point at which your consent is withdrawn.

Objecting to data processing

You also have the right to withdraw your consent to us processing your data at any time. If you object, we will stop processing your data unless, in accordance with legal requirements, we are able to prove that there are compelling legitimate reasons for continued processing that outweigh your rights.

Data portability

You also have the right to receive data that you provided us with in a structured, commonly used and machine-readable format or to request that this data be transmitted to a third party, where this is technically feasible.

 

Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a data protection authority. To do so, you can contact the data protection authority responsible for your place of residence or your federal state or the data protection authority under whose jurisdiction we fall (which is the ICO in the UK).
